4 Rules you must remember for HRA Exemption

Introduction
In my previous article I have explained about the HRA and Tax Benefits. This article explains the HRA exemption for tax savings and how to calculate the allowed limit for HRA exemption. But, doesn’t talk much about the rules or different scenarios involved while applying for the HRA deduction. The scenarios may not be the same while every one apply for the HRA deduction. It depends on the nature rental house and the relationship with the house owner you may get doubts whether you are eligible to claim the tax deduction. This article intend to explore few of the important scenarios while applying for HRA. if you have any points or doubts in your mind and it is covered in the article please post it in the comments section. 1. Rent paid to Parents
You can claim rent given to your parents. If you stay with parents and paying them the rent, they will be land lords and you can show that in the tax deduction as HRA. Note that your parents has to show the rental income in their records to avoid any litigation in the future.
2. Rent paid to spouse
You cannot give rent to your spouse and show that in the records. The rerationship between spouse is not to be considered as the seperate.
3. Keep your rent receipts safe
If the HRA is upto Rs.3000 per month, then the rent receipt is not mandatory. Otherwise you will have to submit the rent receipt proofs to claim the tax deduction.
4. Home Loans and HRA
If you bought a home and repaying the home loans, but some real reasons you could not stay in the home. You can get the tax benefits on the following categories:
- Home loans principal repayment
- Home loans interest paid
- HRA Benefits
Example 1:
If you taken home loan to buy a house in Chennai city. But, your work location is in Bangalore. In that case you will be allowed to claim the following benefits from the Income Tax :
- Tax benefit on principal repayment under Section 80C
- Tax benefit on interest payment under Section 24
- HRA Exemption
Example 2:
If you taken a home loan to buy a house in the Chennai city and the house is not ready to occupy. You are staying in the rented accommodation. In that case you will be allowed to claim the following benefits from the Income Tax :
- Tax benefit on principal repayment under Section 80C
- Tax benefit on interest payment under Section 24
- HRA Exemption
You can claim tax benefits on the housing loan only if your home is ready to live in during that financial year. Once the construction on your home is complete, the HRA benefit stops.
Example 3:
If you taken a home loan to buy a house and you are not staying in that house because it is too far from the work location or any other genuine reason. The home is given for rental. In that case you will be allowed to claim the following benefits from the Income Tax :
- Tax benefit on principal repayment under Section 80C
- Tax benefit on interest payment under Section 24
- HRA Exemption
However, please note the rent you receive would be considered as your taxable income.

Yes..you can claim the all three benefits. It means you are not staying in the own house and staying in the rented house. Note that, in that case you have to declare the rental income for your own house under the Other Income category while filing the tax returns.

Even though you are not staying in the house you will have to declare the notional rent for that house. You have to find out what is the notional rent for your flat. You can claim all the benefits mentioned above.

Basically notional rent is ourself can decide. If you are looking into the neighbor house how much they are paying for the rent, like that you can decide. There is no such rule for showing the notional rent.

This Power of Attorney form gives your attorney the power to act on your behalf during your absence. It authorises your attorney to act as your property manager with the power to:
1. collect rent and other charges owing from tenants,
2. take legal action for any non-payment,
3. pay taxes, charges and assessments in connection with the properties,
4. let vacant rental units to new tenants,
5. hire workmen, groundskeepers and contractors to maintain the properties,
6. generally manage the rental properties for you.You can get the home loan exemptions. But not HRA if you are staying in the same house or not in India.
The income is yours not your father’s. He is just acting as your power.

For the principal payment, it is maximum os Rs.100000 under section 80c. It may be two houses. But, with the maximum limit. Interest payment you can avail for all the houses. One house with Rs.150000, other rented houses there is no limit.

HRA is deducted under section 13A. It is not covered under section 80C which is Rs.100000 tax exemption. Tell them as follows:
1. Rs.100000 exempted under the section 80C. It covers investments like LIC Premium, PF, PPF, NSC, Mutual Funds, Home Loans, etc.
2. Under section 13A, there is deduction for the HRA. The amount is as specified in the limit. For details read this article.
Many people aware of only the section 80C, so they think that maximum they can save is Rs.100000. That is not true. Still, there is some other sections where you can deduct more money like children’s education fees, family medical insurance, etc.

I think I have confused you. The house which you are staying you can claim the HRA exemption. Apart from that, you can show one house as the self occupied(own house) which your parents are staying. Yes. you need not show the rental income for that house if that is only one house you own.

You can claim the interest paid before possession only after taking the possession. That too in the five installments. You can get the tax benefits for FY 2010-11.

You can claim the tax benefits and HRA exemption. You have to show the rental income for the house. If you are paying the entire loan, then 100% rental income you have to show. Even though it is received in your wife name, the income will be clubbed in your name.
