HRA and Tax Benefits

Introduction

In this article I will be explaining about the tax declaration for House Rent Allowance(HRA). If you are employed in any company you would have got hrarequest from your employer to update the Tax Planning and Declaration for 2009 – 2010. Then you can declare tax savings on Section 80c for Rs.10000 and home loans if you have taken one, insurance premium, medical insurance policy or savings on Fixed Deposit, PPF. etc. Apart from all these investments and savings, Income Tax act 1961 has the provision for declare the HRA paid by your employer for tax savings. The amount you can claim as the HRA exemption is under rules and calculation given by the section 10 (13A). This article explores more details into that section and will explain you how much you are eligible to declare under the HRA. I would like to answer all you queries in the comments section. HRA and Tax Benefits

Every one who are receiving the HRA benefits from their employer is eligible to declare the HRA as the tax savings. Note that, if you are staying in the rental house then only it is applicable. If you are reside in your own house, then you will not be eligible to claim the tax benefits for HRA paid by your employer. The details about the HRA exemption in described under Section 10 (13A) of the Income Tax act 1961. The following are the three conditions to eligible for HRA exemption:

  1. HRA must be included in your salary component
  2. You are staying in the rented house
  3. Your rent is more than 10% of your salary

HRA Limit for Tax Exemption

There is certain provisions to calculate the HRA amount you are eligible to claim as the tax benefits. Use the following three conditions to calculate the HRA and least of the following three can be claimed as the tax ememption:

  1. The amount received as HRA from the employer
  2. 40% of salary. It is 50% of salary if you are staying in any of the four cities: Delhi, Mumbai, Chennai or Kolkata.
  3. Rent paid minus 10% of salary

For example, if your salary is Rs. 11000 (here salary is basic component in the gross salary). Your rent paid is Rs.6000. HRA component in the salary is Rs.4500 and you live in Bangalore city. Apply the above rules as follows

  1. HRA received : 4500
  2. 40% of salary : 4400
  3. Rent paid minus 10% of salary : Rs.6000 – Rs.1100 = Ra.4900

In the above scenario, you are eligible for the amount of Rs.4400 as the HRA deduction from your taxable income. I hope this example clears your doubt on HRA calculation.

    Legally speaking it is not the proper way. But, there is no process to check whether they are living in the own house or rental house. If you submit rental receipt, you cannot submit home loans exemptions.

    Please get the components included in the salary. If you are receiving the salary from company, definitely you will have different components like Basic, HRA, Allowance, etc.

    If you are living with parents, you can claim the HRA if the house is in your parents name. In that case you have to treat your parents as the house owner. Hope this clears your doubts.

    Many people think that if they have the own house they can’t claim the HRA benefits. It is widespread opinion among people. But, in many cases people buy the apartment and still stay in the rented house for many reasons. They can claim the HRA in that case.

    To answer this question, we need to look at the relevant part of the I-Tax Act and the rules.

    The exemption of HRA is covered under Section 10 (13A). Simply speaking, the only conditions for allowing the exemption of HRA are:

    Rent must actually be paid by the assessee (legal term for the person whose tax liability is being worked out) for the rented premises which he occupies

    The rented premises must not be owned by him.

    As long as the rented premises are not owned by the assessee, the exemption of HRA will be available up to the limits specified in the relevant rules. There is no mention here about any effect on the exemption because of ownership of any other property.

    Let us now turn to the deduction of interest payable on a home loan. Contrary to popular perception, the interest is not a straight deduction allowed from the salary income. The deduction is actually allowed while calculating the income from house property; although the effect (as we will see below), in the case of self occupied property, is the same as allowing it as direct deduction from salary income.

    Yes..both of you can claim the tax benefits on HRA. Please note that it depends on the maximum limit you are eligible for HRA. As I mentioned in this article Use the following three conditions to calculate the HRA and least of the following three can be claimed as the tax exemption:

    You have to calculae the HRA based on your residing city where your office is located. For example if you are working in Bangalore, then HRA will be calculated for Bangalore only. Not in chennai where your parents are located. Hope this clears your doubts.

    You can apply only for 40% HRA benefits. It is not abou how many houses you are paying the rent, important point is where you are located for work purpose. I would advice you to consult your company HR dept. for more policy details on your company.

    You took a home loan and have got the home. But you are not staying in it for genuine reasons.

    It could be that the home is at a considerable distance from your work place. Or, it could be that the home is rather small and your parents are living in it so you have to stay elsewhere.

    Though your rental accommodation and home are in the same city, you can still get all the benefits.

    Q1 . I am staying with my mother and paying rent to her to claim HRA. I showed 25000/- rent last year and now I would like to show 35000/-.Is there any issue to show this rent which is higher than market rate (market rate is around 20000) but according to my salary structure to save HRA ?

    Q2. Secondly , I have taken a home loan jointly with my wife for a flat near to my office.I paid all initialamount 15% & later on paid additional amount for pre-closing home loan.But all EMI was paid by myself & my wife jointly in 50:50$%. Now this year I will get the possesion for flat , so can we both claim Tax exemption on interest paid in last four years seprately 150000/- ?
