Many people not aware of the from 16 and the intention of this post is to provide details about the form 16 and why it is needed. Form 16 and 16A is similar in nature with small difference. In simple words, form 16 is the proof for your income and tax paid to the govt. before filing the IT returns. Most of the banks prefer to have the form 16 for verification for find your income. What is Form 16?
If you are salaried employee in an organization, then you will get the salary after deducting tax by the employer. This process is called as Tax Deduction at Source (TDS). Every company has to get the TIN. TIN is Tax Identification Number. This number is issued to a person who is responsible to deduct Tax on payments made to employees.
At the end of financial year, company must issue a form 16 which contains the details about the salary earned by that employee and how much tax deducted. It will have details on each month. In simple terms Form 16 is details about the tax deducted by the employer in behalf of employee. The same will be paid to government by the company. Many people think that getting the Form 16 alone is enough for the tax filing. Receiving the form 16 is different from filing the tax returns. Tax payer has to use the Form 16 to file the IT return every financial year end.
For example, if you have worked in two different companies in the same financial year, you must obtain the two Form 16 to file the IT returns.
Form 16 is Certificate of deduction of tax at source under section 203 of the Income Tax Act, 1961. Employers provide TDS certificate to the employees on Form 16.
It is not compulsory to give the form 16 to the employees if there is no TDS deducted.
What is Form 16A?
The purpose of the Form 16 and 16A is the same except the issuing person. Form 16 is applicable only to the salaried employee. There is many other areas where TDS can be applicable like deducing the tax for interest earned by your Fixed Deposit in the Bank. Here bank is the person who deducts the tax. For every financial year they must issue a TDS certificate to the customer. They have to fill the Form 16A and hand over to the customer.
- Example for Form 16A:
- Form 16A is provided by any other institutions deducted the tax in the form of TDS has to issue Form 16A. For example, you are working as an agent for a bank, they provide you the commissions for the sales. In that case they will deduct the tax and give you the money. At the end of year, they will give you Form 16A with the details of tax deducted on your commissions. This form will be used same like Form 16 to submit your IT returns.
- Form 16A is issued in the following cases:
- For interest on securities; dividends;
- interest other than interest on securities;
- winnings from lottery or crossword puzzle;
- winnings from horse race;
- payments to contractors and sub- contractors;
- insurance commission;payments to non-resident sportsmen/sports associations;
- payments in respect of deposits under National Savings Scheme;
- payments on account of repurchase of units by Mutual Fund or Unit Trust of
India; - commission, remuneration or prize on sale of lottery tickets;
- rent;
- fees for professional or technical services;
- income of foreign companies referred to in section 196A(2);
- income from units referred to in section 196B;
- income from foreign currency bonds or shares of an Indian company referred to in section 196C;
- income of Foreign Institutional Investors from securities referred to in section 196D

My income for 2010 – 2011 was 3.10lacs/annum.
I believe non taxable income for men is 1,40,000
I invested 56k in some policies which will save 100% tax
I gave medical bills for 15k
Conveyance 9600
HRA 96k
Total comes out to be 3,14,600
Do i still need form 16, as there was no tax deduction from employer and as per the break up i believe my income is non taxable

I have two questions:
1. If I need not pay any tax for an Assessment Year, can I still get a Form 16?
2. In an Assessment Year, if I worked as Contractor for 3 months and was full time employee for the remaining 9 months, can I get both Form 16 A and Form 16?

Dear sir,
I am working on third party pay roll in CEAT LTD from April 2009 to till date. My employer did not deduct my TDS from my salary & my salary for FY 2009-10 was CTC Rs 12500/- PM & for FY 2010-11 was CTC Rs 13750/-
Now I require FORM 16 for my Home Loan. how to get the FORM 16 for last two FY?

Hello,
I am a senior citizen & have a fixed deposit of 2 lakhs in a bank.
For the year 2010-11 they have deducted 20% tax rate for the interest, eventhough I have produced the PAN card & the necessary forms.
Now, how can I get back that amount?

In financial year 2010-2011 i have worked in two companies and from both companies(current and previous) i have obtained form 16.The aggregate salary shown in both forms is less than Rs.5,00,000 and hence no income tax deductions at source.Do i still have to file IT returns fro assessment year 2011-2012 i.e. till 31st July 2011?

In financial year 2010-11 i have worked in two companies as differenct role.
In April-2010 i worked in TCS and my income of fees for professional or technical services(Section 194J). and they deducted tax from my fees and provide me Form 16A.
From May-2010 to March – 2011 i worked as a salary employee in another company.
I have two types source of income (1) fees for professional or technical services (2) salary employee. so I am confusing about which ITR form should i fill up? ITR-1 or ITR-4.

My present employer did not deduct my TDS for year2010-2011. As per them , our company , a trading division which was about 16 months before and i am working in same , had sales less than 60 lac in 2009-2010 and a company can deduct TDS only one year after the year they have sales more than 60 lacs. Now in year 2010-2011, our sales are around 3.5 Crores and they have started deducting TDS also from April-2011.
Please advise me what kind of certificate/letter can i have from my company in place of Form 16 in this case so that there are no problems for me in future when i apply for Home loans etc.

My salary was below tax deduction limit even before deduction of savings. My company is not issuing Form 16 to me.
I need to file IT Return.
1) How can I file the IT return without Form 16?
2) Is it compulsory for the employer to issue Form 16?
3) What are other alternatives of Form 16 that an employer can give?

Your article is great. Still I feel you have mentioned TIN in place of TAN. TIN is used in cases which involves Sales Tax/VAT. TAN is used for Income Tax. I hope you will check this and clarify me. Thank you in advance for your answer.

My company is not giving Form 16 to its employees. Instead they are issuing Tax Sheet showing all the contents of Form 16, company PAN, TAN and undersighned by payroll Manager. Should we insist for Form 16 or this taxsheet will be sufficient for filing income tax returns.

Now i dont have and also i am not paying tax because my income less and there in no tax deduction from our company. Bank peoples are telling that if you are not paying tax than also I have to provide tax return like that they are telling.

Form 16 gives information on Tax Deducted by your employer. Your employer can get it from NSDL site by using his login ID, TAN etc. Once he gets form 16 (usually that is send to the employer’s mail ID directly from the site), he can send it to the employees. Form 16 can be availed even if no tax had been deducted; in that case the TDS details will show an amount of ‘zero’. Form 16 is an employee’s right and the employer can be penalized for not giving form 16. Guys… you have to be assertive in asking for Form 16. After all it is your lives, jobs and money…

IT Return can be submitted even if there is not tax to be paid. There is nothing in IT Act 1961 which restricts a person from submitting such a return. Many people do that. Go ahead submitting your IT returns.

I was working in a company where i use to get salary in the form of cash or check. The salary which i used to get was also below the taxable limit. No tax has been deducted from my salary.
In my present company, they need form 16 as a proof of my salary from my previous organization. I am not sure that whether my previous company has TAN or not.

Can you please guide me in following.
I joined a new company in January 2011 year. Previous to that I was working in a newly start up company and my Salary was below 1,60,000/-. So there was no tax deducted in my pervious company.
Now I’m filling up my Employee Proof Submission for the 2011-12 in my current company. So I need to submit details of my Previous Employer. My previous employer is saying they Don’t have TAN number and also there was no TDS so they can’t give me Form16 or IT Computational Sheets(which I can submit since in mid year I can’t get form 16)
My current company is saying either form16 or Tax Computationcal Sheets with a TAN is required/mandatory.
Now i want a home loan in LIC. They are asking to submit Form 16. So in this case what should I do?

I have both form 16 and form 16 A for this year. The reason is I worked as a profressional/contractor for the last 2 months.
When I file my return I enter all the details and tds deducted from salary. How should I club the income from professional services and tds 10.3% deducted as TDS.
Please let me know if I have any other deductions available for these 2 months for which I can claim exemption of income.

I am working as a Lecture in engg. college. For last Financial year 2010-2011 i did not receive form 16 from our institution, because my income is below the taxable.
But now( sep 2011) i plan to apply for home loan. In bank there are asking form 16. So i am in need of form 16. Now i am asking form 16 from our institution. But they told that period of providing form 16 is over(last date for providing form 16 is july 2011). so we cannot produce form 16.

I recently changed my company. In my previous company i am not under tax bracket so no tax was cut(Only Professional tax was cut). But in my new company i am in tax bracket so they are asking me Form – 16 of previous employer. Is it mandatory to produce Form-16 or can i ignore it.
