Tax Exemption for Tuition Fees u/s 80C

Introduction
In my previous posts I have explained about the tax savings on section 80c and other useful articles on the tax planning, fixed deposit savings, etc. In this article I will write about one of the tax exemption components missed in my previous articles. Tuition Fees for Children
Full time education of any two children in any university, college, school or other educational institution, subject to over-all limit of tax deduction under section 80C. The maximum limit for the tuition fees is Rs.100000. That means one can utilize the entire exemption u/s 80c.
The following are the deduction allowed under tuition fees
- Fees paid to regular educational institution irrespective of the class attended by the child.
- Payment of fees to play schools or crèches will be allowed as deduction.
- Fees for admission are excluded from amounts eligible for deduction.
- The deduction is allowed only for two children.
- Deduction is available of paid basis.
- Adopted Child’s tuition fees is also eligible for deduction
The following are the deduction not allowed under tuition fees
- Deduction is not allowed for private tuition, coaching center.
- University College School or other educational institution must be situated in India. It can be affiliate to any foreign university.
- A late fee is not eligible for deduction.
- Development fees or donation is not eligible.
- Payment of fees for overseas education is not allowed.
- Fees for admission are excluded from amounts eligible for deduction.
- Transport charges, hostel charges, Mess charges, library fees charges incurred for education are not allowed
- Spouse’s tuition fees is not allowed for deduction.

Lot of Indians nowadays are either studying and working or taking time off from work to pursue a masters or postdoctoral degree. A few lucky ones would have their spouse supporting them by working, but the majority finance their education through loans and savings.
Unfortunately for such persons, the Indian government deems them unworthy to receive a tax deduction for education. I find this very unfair as self education is also important and needs to be encouraged as part of an individuals effort to continuously upgrade himself/herself.
My 2 cents worth is that the government just needs to lay down a condition that only full time or part time course leading to a degree or higher qualification from a recognised university will be eligible for the deduction, and then provide tax relief to all eligible citizens. This will reduce the chances of misuse of the tax rule, while allowing genuine taxpayers a relief for the EMI towards the education loanApril 2nd, 2010 at 2:58 am -
